Agreement to Terms

By accessing or using CrowdPics ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

These terms apply to all users, including business customers, venue operators, and guests who upload photos through the platform.

Description of Service

CrowdPics provides a digital signage platform that enables businesses to display user-generated photos on TV screens. The Service includes:

  • CrowdPics TV application for Fire TV devices
  • Web-based guest upload interface
  • Administrative dashboard for content management
  • Optional AI-powered photo filters
  • Cloud storage for uploaded photos

Account Registration

To use the Service as a business customer, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

Subscription and Payment

Billing

  • Subscriptions are billed monthly or annually in advance
  • Prices are subject to change with 30 days notice
  • All fees are non-refundable unless otherwise stated

Cancellation

  • You may cancel your subscription at any time
  • Access continues until the end of your current billing period
  • No partial refunds for unused time

Acceptable Use

You agree not to use the Service to:

  • Upload illegal, harmful, or offensive content
  • Violate intellectual property rights of others
  • Distribute malware or engage in hacking activities
  • Harass, abuse, or harm other users
  • Impersonate others or misrepresent your identity
  • Interfere with the proper functioning of the Service
  • Circumvent security measures or access controls

We reserve the right to remove content and suspend accounts that violate these terms.

Content Ownership

Your Content

You retain ownership of photos and content you upload. By uploading content, you grant CrowdPics a license to:

  • Store and display your content on designated devices
  • Process your content through our AI filters (if enabled)
  • Create backups for service reliability

Guest Content

Guests who upload photos grant you (the venue) and CrowdPics the right to display their photos as part of the Service. You are responsible for obtaining appropriate consent from guests at your venue.

Content Moderation

You are responsible for moderating content displayed at your venue. We provide tools to:

  • Review photos before public display
  • Remove inappropriate content
  • Block specific users from uploading

We may also remove content that violates our policies or applicable law.

Intellectual Property

The CrowdPics platform, including its software, design, logos, and documentation, is owned by CrowdPics and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOU USE THE SERVICE AT YOUR OWN RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CROWDPICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO CROWDPICS IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless CrowdPics from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these terms.

Termination

We may terminate or suspend your access to the Service:

  • For violation of these terms
  • For non-payment of fees
  • At our discretion with reasonable notice

Upon termination, your right to use the Service ceases immediately. Your data may be deleted according to our data retention policies.

Governing Law

These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of California.

Changes to Terms

We may update these terms from time to time. We will notify you of material changes by email or through the Service. Continued use after changes constitutes acceptance of the new terms.
